The customer agrees to the following terms and conditions. By placing an order the client is authorizing the company to pass on the order to the respective merchant / vendor and make sure the product is delivered to the given address. While rendering the service the company is acting only as an authorized representative of the client and not as his agent or in any other capacity.

The company shall be handling the material only as a service provider and its liability shall be restricted to that of a bailee under the contract Act. Nothing contained herein shall create or be deemed to create or construe a relationship between the parties such that FlowerCiti.com is regarded as a seller or purchaser of the Vendor / Merchant's products and all sales and purchases of the Vendor / Merchant's products pursuant to an order placed on the Internet Properties are transactions between the user placing an order for the same on the FlowerCiti.com.

Definitions:

• FlowerCiti.com: The company providing the online store and delivery service for sending flowers, chocolates and cakes.

• Customer: The person using the online store and delivery service.

• Products / Goods: Products ordered by the customer.

• Perishable Goods: All products in the Flowers, Cakes and chocolates and Indian Sweets sections.

• Products: The products delivered to the recipient will be generally as per the description stated against each of the product displayed and as per the picture chosen by the customer.

There may be variations in appearance and colors especially in the perishable goods like flowers, cakes and chocolates and Indian Sweets. The customer agrees to the variations and understands the nature of the variations and allows FlowerCiti.com to deliver a product, which is similar to the product picture exhibited on the web site. Flowers specified in the arrangements shown may differ as per the seasonal availability. If the Flowers specified in the arrangements are not available suitable alternatives will be used.

Payments:

Charges displayed on the site are inclusive of cost of the product; delivery charges may be additional in some cases, service fee for charging credit cards and facilitation fee (Details of break up will be provided on request).

In case the customer would like to pay using an alternate payment mode that is acceptable to us the service fee for charging credit cards will be deducted from the total amount payable.

If the product is picked up directly by the customer from the vendor the applicable delivery charge will be deducted from the total amount payable by the customer. We accept all International Master and Visa Cards.

Customers should make a careful note that this online payment gateway accepts payments only in US Dollars Therefore; the amount displayed when the customer clicks on the currency converter is just for information purpose.

Refund Policy:

• Non Availability: If the ordered product is out of stock and FlowerCiti.com is unable to deliver the product, a complete refund will be made to the customer. We shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc caused due to non-delivery and non-availability.

• Delivery Attempt: When FlowerCiti.com tries to deliver the product, and is unable to do so due to either:
   - A wrong address or
   - No one being at home.
   - Political disturbance
  In case a delivery attempt was made and could not be delivered due to either a wrong address or no one at home, or political disturbance no refund will be given.

• Late Delivery: If the delivery is not made on the requested date for the reasons other than mentioned in the clause “Delivery attempt” FlowerCiti.com will refund to the customers in full. If the customer yet require a delivery to be made, than we shall provide with 10% discount on the order value for customers next preferred date.
  
  In case a delivery attempt was made and could not be delivered due to either a wrong address or no one at home, or could not deliver due to political disturbance, in such case no refund will be given to the customers.
  
  Perishable goods - Three delivery attempts will be made to deliver all perishable orders within a period of 24 hours. After three delivery attempts the order will be cancelled and no further attempt will be made to deliver it. No refunds or cancellations will be made for perishable goods.

Delivery Period and Timing:
FlowerCiti.com shall try to deliver the product on the requested date. In case delivery coincides with a festival day or a national holiday. Delivery shall be made in the course of the day, and the customer agrees to refrain from requesting for deliveries at very early or late hours of the day. All attempts will be made to deliver at the specified time on the preferred date of delivery but FlowerCiti.com will not be held liable if the delivery does not take place on the specified time.

Cancellations:
Once a product is ordered the customer cannot cancel it. The reason being that the system immediately processes the order and sends shipping instructions to vendor’s worldwide. Due to the high volume of transactions and because the instructions are sent to over 140 Countries it becomes difficult to cancel the orders.

In case we receive a cancellation notice and the order has not been processed by us, we shall cancel the order subject to a genuine reasoning.

FlowerCiti.com has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by FlowerCiti.com and accept FlowerCiti.com decision regarding the cancellation.

On cancellation of an order after it has been processed by FlowerCiti.com and not yet delivered, the cancellation charges will be as follows:

• Perishable Products (flowers, cakes and chocolates, Indian Sweets) - Cancellation charge would be 75 %, and refund to the customer would be only 25%.

• Non Perishable Products (all others categories) - Cancellation charge would be 75%, and refund to the customer would be 25%.

Once a delivery attempt is made, no cancellation will be accepted and no refunds will be made.

Warranty:
Perishable Products - FlowerCiti.com does not provide any warranties on the products it delivers.

Disputes:
All and any disputes related to "FlowerCiti.com" service shall be subject to the jurisdiction of Mumbai (India) courts.

Fraudulent / Declined Charges:
FlowerCiti.com reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the site fraudulently. FlowerCiti.com reserves the right to sue the recipient in case of fraudulent charges and denial of charges by the customer.
